GmbH &amp; Co. KG (hereinafter referred to as \"KVG\") operates a booking platform under the product name \"elbMOBIL\" for on-demand surface transport with motor vehicles (hereinafter referred to as on-demand transport). The corresponding transport service is provided by KVG or by third parties commissioned by it. The transport of the on-demand lines is integrated into the Hamburg Transport Association (hvv) in terms of transport and tariffs.<\/p><p>These terms of use apply to all legal relationships in connection with the provision and use of the booking platform. The on-demand transport services booked via the booking platform are subject to the hvv tariff conditions. The current version of the fare conditions can be found at <a href=\"http:\/\/www.hvv.de\/de\/gemeinschaftstarif\" target=\"_blank\" rel=\"noopener\">www.hvv.de\/de\/gemeinschaftstarif<\/a> to view. To do this, the person using the app enters their first and last name and the mobile phone number they use. An e-mail address can also be entered. They must also agree to the terms of use for the booking platform. Non-binding journey requests can now be made via the app, stating the desired departure and destination points and the desired departure or arrival time.<br \/><br \/>Alternatively, the person using the app can authorise the use of their own location data (geolocation) in the app, which is then automatically suggested as the starting point for journey requests. This suggestion can be overwritten at any time. Once authorised, the use of location questions can also be switched off in the app at any time. After entering and confirming the desired journey data, a specific journey suggestion is made via the background system of the booking platform, taking into account the currently available space capacities, stating the following parameters and displaying them to the person using the app: estimated pick-up time<\/p><ul class=\"icons\"><li>Estimated time of arrival (time slot)<\/li><li>Estimated journey time<\/li><li>Estimated route<\/li><li>Route from the location to the pick-up point (visualised on a map)<\/li><li>Route from the pick-up location to the arrival location (route visualised on a map)<\/li><li>Route from the point of arrival to the destination (visualised on a map)<\/li><li>Period of validity of the offer<\/li><li>Fare<\/li><\/ul><p>This journey suggestion can be confirmed by the person using the app within a displayed time period using a selection button. In this case, the journey suggestion becomes a binding booking for the journey and the four-digit authorisation code for this journey is displayed via the app. If the journey suggestion displayed via the app is not accepted within 30 seconds, the journey suggestion expires without any costs being incurred. The person using the app can also actively cancel a journey suggestion free of charge within the 30-second period. However, a journey suggestion is only generated and displayed if the departure or arrival time predicted via the booking platform is no more than 20 minutes away from the departure or arrival time requested by the person using the app. If this is not possible depending on the current booking situation, this will be displayed via the app.<\/p><p>\u00a0<\/p><h4>Booking by telephone<\/h4><p>Passengers who do not have a suitable terminal device are offered the option of booking by telephone. In this case, the actual booking process in the elbMOBIL system is carried out by the booking hotline staff. The successful conclusion of the contract of carriage is indicated by the four-digit authorisation code for the journey. The person using the app owes KVG the fare specified at the time of booking. The fare is made up of the relations-related connection price in accordance with the hvv Community Tariff and a surcharge applicable to the on-demand lines (elbMOBIL surcharge).<\/p><p>Passengers who have an hvv ticket valid for on-demand transport in terms of time and place can enter this in the passenger settings of the app when booking. Only the surcharge applicable to on-demand transport is then paid.<\/p><p>When boarding the vehicle, all passengers must present the authorisation code (verbally or visually) and, if an hvv ticket is used, show the original ticket. Both must be presented without being asked. The ticket inspector is authorised to look at and touch the ticket to check it carefully. Prepay methods are also available to minors of limited legal capacity aged 7 and over.<\/p><p>\u00a0<\/p><h4>Booking via the app<\/h4><p>Payment for journeys booked via the app within the elbMOBIL service area is made exclusively electronically via the app. If the journey is to be continued beyond the elbMOBIL service area, the person using the app indicates \"I have an hvv ticket\" during the booking process and then purchases this directly from the elbMOBIL driver.<\/p><p>\u00a0<\/p><h4>Payment methods and billing<\/h4><p>The person using elbMOBIL can choose between the following payment methods for booking journeys in the app:<\/p><ul class=\"icons\"><li>Billing via the SEPA direct debit scheme<\/li><\/ul><ul class=\"icons\"><li>Billing via credit card (Visa, MasterCard)<\/li><li>Payment via PayPal<\/li><li>Prepayment (credit account)<\/li><\/ul><p>Other payment methods are excluded. The person using the app is not entitled to a specific payment method. LogPay will generally collect the claim via SEPA direct debit or credit card within the next five bank working days after the ticket has been purchased. The debiting of the account or credit card depends on the processing of the payment service provider of the person using the app. The overview of the ticket purchases made (hereinafter also referred to as \"sales overview\") contains individual proofs of purchase and can only be viewed and retrieved electronically by e-mail or via the app and only by the registered person.<\/p><p>\u00a0<\/p><h4>Payment by SEPA direct debit<\/h4><p>If the SEPA direct debit procedure is selected, personal data of the person using the app (first name, surname, address, date of birth and email address) and an account details within the European Union are required for the clear allocation of a payment for a purchased ticket. If this payment method is selected, the app user authorises LogPay to collect payments from their specified account by SEPA direct debit with their consent to these terms of use. At the same time, the app user instructs their payment service provider to honour the direct debits drawn on their account by LogPay. The person using the app is informed that they can request a refund of the debited amount within eight weeks of the debit date. The conditions agreed with their payment service provider shall apply. In the event that the person using the app is not the account holder of the specified account, they shall ensure that the account holder has given their consent to the SEPA direct debit.<br \/><br \/>The person using the app undertakes to provide all account details required for participation in the SEPA Direct Debit Scheme (in particular the account holder and International Bank Account Number (IBAN)) and to enter them in the app. In the SEPA Direct Debit Scheme, LogPay will send a pre-notification of the collection date and amount. The person using the app will receive the prenotification at least two days before the claim is collected. The prenotification is sent electronically with the order confirmation to the e-mail address provided.<br \/><br \/>The person using the app must ensure that the specified account has sufficient funds so that the SEPA direct debit can be collected. If a SEPA direct debit is returned by the payer without authorisation or the collection of the claim from their payment service provider fails for reasons for which they are responsible - in particular due to insufficient funds, incorrect or invalid account details or objection - they are obliged to provide sufficient funds or to remedy the reason for the payment disruption so that, in addition to the outstanding amount, the third-party fees incurred by the payment service provider can be collected on the date specified in the reminder. LogPay is entitled to claim further damages for default.<br \/><br \/>By agreeing to these Terms of Use, the person using the app waives the right to obtain a written SEPA direct debit mandate. The waiver is declared by the app user to their payment service provider, the creditor's payment service provider and the creditor. The app user agrees to the waiver being passed on to the aforementioned parties. If the waiver lapses or becomes ineffective, the person using the app is obliged to submit a written mandate without delay. If the person using the app is not the account holder, they are obliged to forward the mandate reference number to the account holder.<\/p><p>\u00a0<\/p><h4>Payment by credit card<\/h4><p>Purchased tickets can only be billed by credit card using Visa or MasterCard. Other types of credit card are not accepted.<br \/>During the order process, the following credit card details of the person using the app are recorded<br \/><br \/><\/p><ul class=\"icons\"><li>Surname and first name of the credit card holder<\/li><li>Credit card type (Visa, MasterCard)<\/li><li>Credit card number<\/li><li>Credit card expiry date<\/li><li>CVC code of the credit card<\/li><\/ul><p>and transferred to the LogPay server for debt collection. LogPay's system checks the credit card details provided by the person using the app for accuracy and any blocking notices from the respective credit card issuer. In the event that the person using the app is not the holder of the credit card provided, it ensures that the cardholder has authorised the charge. The person using the app must also ensure that the specified credit card is not blocked and has a sufficient limit. If the authorisation fails for any reason, the person using the app will receive a corresponding error message.<br \/><br \/>The time at which the amount is debited from the account is determined by the respective credit card agreement between the person using the app and their payment service provider.<br \/>If the payment service provider supports the \"3D Secure procedure\" (Verified by Visa \/ MasterCard\u00ae SecureCode\u2122), this is used to increase security against misuse for payment by credit card. If the payment service provider does not support the 3D Secure procedure or does not consider it necessary to carry out the 3D Secure procedure, the check will not be carried out.<br \/><br \/>The person using the app must ensure that the claim can be collected via the credit card. If the app user unjustifiably initiates a charge back (return of the amount) or the collection of the claim fails for reasons for which he\/she is responsible, he\/she is obliged to ensure sufficient funds or to remedy the reason for the payment disruption so that, in addition to the outstanding amount, the third-party fees incurred by the payment service provider can be collected on the date specified in the reminder. LogPay is entitled to claim further damages for default.<\/p><p>\u00a0<\/p><h4>Payment via PayPal<\/h4><p>To pay with PayPal, the person using the app selects \"PayPal\" as the payment method. They are then redirected to the PayPal website where they enter the required data. As a non-registered user, they confirm the payment. As a registered user, the person using the app concludes a billing agreement with LogPay, under which the PayPal account of the person using the app is debited with the receivables due. The purchase offer of the non-registered or registered person can only be accepted if his\/her PayPal account is successfully debited. The person using the app will either receive a confirmation or a rejection.<br \/>It is also possible to buy credit packages of 5, 10 or 20 euros via the app and pay with the stored payment method. If the person using the app does not turn up at the pick-up point at the specified departure time, any ticket purchased via the booking platform will also not be refunded.<\/p><p>All journey bookings made via the booking platform can also be cancelled by KVG at any time. This may be the case, for example, in the event of a technical defect, accident or serious traffic obstructions due to traffic jams or weather conditions. Gegenstand Die KVG Stade GmbH &amp; Co. KG (im Folgenden \u201eKVG\u201c) betreibt unter dem Produktnamen \u201eelbMOBIL\u201c eine Buchungsplattform f\u00fcr einen bedarfsgesteuerten Fl\u00e4chenverkehr mit Kraftfahrzeugen (nachfolgend On-Demand-Verkehr). Die entsprechende Bef\u00f6rderungsleistung wird durch die KVG oder durch von ihr beauftragte Dritte erbracht. Der Verkehr der On-Demand-Linien ist verkehrlich und tariflich in den Hamburger Verkehrsverbund (hvv) integriert. Diese Nutzungsbedingungen gelten f\u00fcr alle Rechtsbeziehungen im Zusammenhang mit der Bereitstellung und Nutzung der Buchungsplattform. Die \u00fcber die Buchungsplattform gebuchten Bef\u00f6rderungsleistungen des On-Demand-Verkehres unterliegen den Tarifbedingungen des hvv. Die jeweils aktuelle Fassung der Tarifbedingungen sind auf www.hvv.de\/de\/gemeinschaftstarif einzusehen. Zus\u00e4tzlich wird ein Komfortzuschlag in H\u00f6he von 1,50 Euro pro Person und Fahrt erhoben. 2. Registrierung Voraussetzung f\u00fcr die Nutzung der Buchungsplattform f\u00fcr den On-Demand-Verkehr ist zun\u00e4chst die Installation der von der KVG im Google Play Store und im Apple Store kostenfrei zum Download angebotenen elbMOBIL-Applikation (\u201eApp\u201c) auf einem mobilen Endger\u00e4t und die dar\u00fcber erfolgende einmalige Registrierung als Nutzerin oder Nutzer (Anlegen eines Kundenkontos). Die App nutzende Person gibt dazu ihren Vor- und Nachnamen sowie die von ihr genutzte Mobiltelefonnummer ein. Zus\u00e4tzlich kann auch eine E-Mail-Adresse angegeben werden. Au\u00dferdem muss den Nutzungsbedingungen f\u00fcr die Buchungsplattform zugestimmt werden. Auch das Hinterlegen einer Kreditkarte ist m\u00f6glich. 3. Buchung von Fahrten des On-Demand-Verkehres Buchung \u00fcber die App Nach erfolgter Erstregistrierung (siehe \u00a7 2) ist die App nutzende Person f\u00fcr das Stellen von Fahrtanfragen sowie deren Buchung freigeschaltet. \u00dcber die App k\u00f6nnen jetzt unter Angabe von gew\u00fcnschtem Start- und Zielpunkt sowie der gew\u00fcnschten Abfahrt- oder Ankunftszeit unverbindliche Fahrtanfragen gestellt werden. Alternativ kann die App nutzende Person in der App die Nutzung eigener Standortdaten (Geolocation) freigeben, die dann automatisch bei Fahrtanfragen als Startpunkt vorgeschlagen werden. Ein \u00dcberschreiben dieses Vorschlags ist jederzeit m\u00f6glich. Auch kann die einmal freigegebene Nutzung der Standortfragen jederzeit in der App abgeschaltet werden. Nach Eingabe und Best\u00e4tigung der gew\u00fcnschten Fahrtdaten wird \u00fcber das Hintergrundsystem der Buchungsplattform unter Ber\u00fccksichtigung der aktuell zur Verf\u00fcgung stehenden Platzkapazit\u00e4ten ein konkreter Fahrtvorschlag unter Nennung folgender Parameter unterbreitet und der App nutzenden Person angezeigt: voraussichtliche Abholzeit voraussichtliche Ankunftszeit (Zeitfenster) voraussichtliche Fahrzeit voraussichtliche Wegstrecke Weg vom Standort zum Abholort (auf einer Karte visualisiert) Weg vom Abholort zum Ankunftsort (Fahrweg, auf einer Karte visualisiert) Weg vom Ankunftsort zum Zielort (auf einer Karte visualisiert) Zeitraum f\u00fcr die G\u00fcltigkeit des Angebots Fahrpreis Dieser Fahrtvorschlag kann von der App nutzenden Person innerhalb eines angezeigten Zeitraums \u00fcber einen Auswahlknopf best\u00e4tigt werden. In diesem Fall wird aus dem Fahrtvorschlag eine verbindliche Buchung der Fahrt und \u00fcber die App wird der vierstellige Berechtigungscode f\u00fcr diese Fahrt angezeigt. Wird der \u00fcber die App angezeigte Fahrtvorschlag nicht innerhalb von 30 Sekunden angenommen, verf\u00e4llt der Fahrtvorschlag, ohne dass hierf\u00fcr Kosten entstehen. Die App nutzende Person kann einen Fahrtvorschlag auch innerhalb der 30-Sekunden-Spanne aktiv kostenlos stornieren. Ein Fahrtvorschlag wird jedoch nur dann erzeugt und angezeigt, wenn die \u00fcber die Buchungsplattform prognostizierte Abfahrt- oder Ankunftszeit nicht mehr als 20 Minuten von der von der App nutzenden Person gew\u00fcnschten Abfahrt- oder Ankunftszeit entfernt liegt. Ist dies in Abh\u00e4ngigkeit zur aktuellen Buchungslage nicht m\u00f6glich, wird dies \u00fcber die App angezeigt. Telefonische Buchung F\u00fcr Fahrg\u00e4ste, die \u00fcber kein geeignetes Endger\u00e4t verf\u00fcgen, wird die M\u00f6glichkeit einer telefonischen Buchung angeboten. Hierbei wird der eigentliche Buchungsvorgang im elbMOBIL-System vom Personal der Buchungshotline vorgenommen. Ohne die Nutzung der App stehen Features, wie die Echtzeitverfolgung des elbMOBILs oder die Benachrichtigung bei eventuell auftretenden Versp\u00e4tungen, nicht zur Verf\u00fcgung. 4. Bef\u00f6rderungsvertrag und Fahrpreis F\u00fcr das Herunterladen sowie die Nutzung der App werden keine Kosten\/Geb\u00fchren erhoben. Die App nutzende Person tr\u00e4gt die aus der Nutzung der App entstehenden Verbindungskosten selbst. Mit Best\u00e4tigung des durch die Buchungsplattform unterbreiteten Fahrtvorschlags kommt zwischen der App nutzenden Person und der KVG ein Bef\u00f6rderungsvertrag \u00fcber die Bef\u00f6rderungsleistung entsprechend der vorausgegangenen Buchung zustande. Das erfolgreiche Zustandekommen des Bef\u00f6rderungsvertrags wird durch den vierstelligen Berechtigungscode f\u00fcr die Fahrt angezeigt. Die App nutzende Person schuldet gegen\u00fcber der KVG den bei der Buchung angegebenen Fahrpreis. Der Fahrpreis setzt sich zusammen aus dem relationsbezogenen Verbindungspreis gem. hvv Gemeinschaftstarif und einem f\u00fcr die On-Demand-Linien geltenden Aufpreis (elbMOBIL-Aufpreis). Fahrg\u00e4ste, die \u00fcber eine f\u00fcr den On-Demand-Verkehr zeitlich wie r\u00e4umlich g\u00fcltige Fahrkarte des hvv verf\u00fcgen, k\u00f6nnen diese bei der Buchung in der Passagier-Einstellung der App angeben. Gezahlt wird dann ausschlie\u00dflich der f\u00fcr den On-Demand-Verkehr geltende Aufpreis. Bei Einstieg in das Fahrzeug m\u00fcssen alle Fahrg\u00e4ste den Berechtigungscode vorweisen (m\u00fcndlich oder optisch) sowie bei angegebener Nutzung einer hvv Fahrkarte diese im Original vorzeigen. Beides hat unaufgefordert zu erfolgen. Das Fahrpersonal ist berechtigt, die Fahrkarte zur genauen Pr\u00fcfung anzusehen und anzufassen. Der Fahrgast ist f\u00fcr den Pr\u00fcfvorgang zur Herausgabe der Fahrkarte verpflichtet. Unentgeltliche Bef\u00f6rderung schwerbehinderter Fahrg\u00e4ste Schwerbehindertenausweise werden im Rahmen des On-Demand-Verkehres nicht anerkannt. 5. Bezahlung Die KVG Stade bedient sich zur Abwicklung des e-Payment-Services des Finanzunternehmens LogPay Financial Services GmbH, Schwalbacher Stra\u00dfe 72, 65760 Eschborn (nachfolgend auch \u201eLogPay\u201c). Der Einzug der Entgeltforderung f\u00fcr die erworbenen Tickets erfolgt durch LogPay, an welche die KVG s\u00e4mtliche Entgeltforderungen einschlie\u00dflich etwaiger Nebenforderungen und Geb\u00fchren verkauft und abgetreten hat (Abtretungsanzeige). Die LogPay ist Drittbeg\u00fcnstigte der nachfolgenden Bestimmungen. Sie ist zudem erm\u00e4chtigt, den Forderungseinzug im eigenen Namen und f\u00fcr eigene Rechnung durchzuf\u00fchren. F\u00fcr die Zahlung des gebuchten Tickets gelten erg\u00e4nzend zu den oben beschriebenen Bedingungen die nachfolgenden Regelungen. Alle Zahlarten stehen nur voll gesch\u00e4ftsf\u00e4higen Personen \u00fcber 18 Jahren zur Verf\u00fcgung. Prepay-Verfahren stehen auch beschr\u00e4nkt gesch\u00e4ftsf\u00e4higen Minderj\u00e4hrigen ab 7 Jahren zur Verf\u00fcgung. Buchung \u00fcber die App Die Bezahlung der \u00fcber die App gebuchten Fahrten innerhalb des elbMOBIL-Bediengebietes erfolgt ausschlie\u00dflich elektronisch \u00fcber die App. Soll die Fahrt \u00fcber das elbMOBIL-Bediengebiet hinaus fortgef\u00fchrt werden, gibt die App nutzende Person im Buchungsvorgang an \u201eich habe ein hvv Ticket\u201c und kauft dieses anschlie\u00dfend direkt beim Fahrpersonal des elbMOBILs. Zahlarten und Abrechnung Die elbMOBIL nutzende Person kann f\u00fcr Buchungen von Fahrten in der App zwischen folgenden Zahlarten w\u00e4hlen: Abrechnung \u00fcber das SEPA-Lastschriftverfahren Abrechnung \u00fcber Kreditkarte (Visa, MasterCard) Zahlung per PayPal Vorauszahlung (Guthabenkonto) Andere Zahlarten sind ausgeschlossen. Telefonische Buchung F\u00fcr Fahrg\u00e4ste, die \u00fcber kein geeignetes Endger\u00e4t verf\u00fcgen, wird die M\u00f6glichkeit einer telefonischen Buchung angeboten. Hierbei wird der eigentliche Buchungsvorgang im elbMOBIL-System vom Personal der Buchungshotline vorgenommen. Ohne die Nutzung der App stehen Features, wie die Echtzeitverfolgung des elbMOBILs oder die Benachrichtigung bei eventuell auftretenden Versp\u00e4tungen, nicht zur Verf\u00fcgung. 4. Bef\u00f6rderungsvertrag und Fahrpreis F\u00fcr das Herunterladen sowie die Nutzung der App werden keine Kosten\/Geb\u00fchren erhoben. Die App nutzende Person tr\u00e4gt die aus der Nutzung der App entstehenden Verbindungskosten selbst. Mit Best\u00e4tigung des durch die Buchungsplattform unterbreiteten Fahrtvorschlags kommt zwischen der App nutzenden Person und der KVG ein Bef\u00f6rderungsvertrag \u00fcber die Bef\u00f6rderungsleistung entsprechend der vorausgegangenen Buchung zustande. Das erfolgreiche Zustandekommen des Bef\u00f6rderungsvertrags wird durch den vierstelligen Berechtigungscode f\u00fcr die Fahrt angezeigt. Die App nutzende Person schuldet gegen\u00fcber der KVG den bei der Buchung angegebenen Fahrpreis. Der Fahrpreis setzt sich zusammen aus dem relationsbezogenen Verbindungspreis gem. hvv Gemeinschaftstarif und einem f\u00fcr die On-Demand-Linien geltenden Aufpreis (elbMOBIL-Aufpreis). Fahrg\u00e4ste, die \u00fcber eine f\u00fcr den On-Demand-Verkehr zeitlich wie r\u00e4umlich g\u00fcltige Fahrkarte des hvv verf\u00fcgen, k\u00f6nnen diese bei der Buchung in der Passagier-Einstellung der App angeben. Gezahlt wird dann ausschlie\u00dflich der f\u00fcr den On-Demand-Verkehr geltende Aufpreis. Bei Einstieg in das Fahrzeug m\u00fcssen alle Fahrg\u00e4ste den Berechtigungscode vorweisen (m\u00fcndlich oder optisch) sowie bei angegebener Nutzung einer hvv Fahrkarte diese im Original vorzeigen. Beides hat unaufgefordert zu erfolgen. Das Fahrpersonal ist berechtigt, die Fahrkarte zur genauen Pr\u00fcfung anzusehen und anzufassen. Der Fahrgast ist f\u00fcr den Pr\u00fcfvorgang zur Herausgabe der Fahrkarte verpflichtet. Unentgeltliche Bef\u00f6rderung schwerbehinderter Fahrg\u00e4ste Schwerbehindertenausweise werden im Rahmen des On-Demand-Verkehres nicht anerkannt. 5. Bezahlung Die KVG Stade bedient sich zur Abwicklung des e-Payment-Services des Finanzunternehmens LogPay Financial Services GmbH, Schwalbacher Stra\u00dfe 72, 65760 Eschborn (nachfolgend auch \u201eLogPay\u201c). Der Einzug der Entgeltforderung f\u00fcr die erworbenen Tickets erfolgt durch LogPay, an welche die KVG s\u00e4mtliche Entgeltforderungen einschlie\u00dflich etwaiger Nebenforderungen und Geb\u00fchren verkauft und abgetreten hat (Abtretungsanzeige). Die LogPay ist Drittbeg\u00fcnstigte der nachfolgenden Bestimmungen. Sie ist zudem erm\u00e4chtigt, den Forderungseinzug im eigenen Namen und f\u00fcr eigene Rechnung durchzuf\u00fchren. F\u00fcr die Zahlung des gebuchten Tickets gelten erg\u00e4nzend zu den oben beschriebenen Bedingungen die nachfolgenden Regelungen. Alle Zahlarten stehen nur voll gesch\u00e4ftsf\u00e4higen Personen \u00fcber 18 Jahren zur Verf\u00fcgung. Prepay-Verfahren stehen auch beschr\u00e4nkt gesch\u00e4ftsf\u00e4higen Minderj\u00e4hrigen ab 7 Jahren zur Verf\u00fcgung. Buchung \u00fcber die App Die Bezahlung der \u00fcber die App gebuchten Fahrten innerhalb des elbMOBIL-Bediengebietes erfolgt ausschlie\u00dflich elektronisch \u00fcber die App. Soll die Fahrt \u00fcber das elbMOBIL-Bediengebiet hinaus fortgef\u00fchrt werden, gibt die App nutzende Person im Buchungsvorgang an \u201eich habe ein hvv Ticket\u201c und kauft dieses anschlie\u00dfend direkt beim Fahrpersonal des elbMOBILs.
